In our society today, practically everyone has a cellphone; and it has even become common for an individual to use it to videotape events, etc. Moreover, it is not uncommon for parents in custody matters to employ the use of cellphone videoing to record exchanges, etc. when there is protracted litigation. In fact, the Pennsylvania Supreme Court in a recent opinion involving “nanny cams” stated that “[n]otably, the use of recording devices in homes as a means for parents to monitor people hired to care for their children have become so commonplace that these devices are often referred to as “nanny cams.”
